DRAGAN GAJIĆ AND SAMIR ETEMOVIĆ ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

Dragan Gajić and Samir Etemović, the accused persons, have entered into a plea agreement admitting guilt for the criminal offense of Organized Crime in violation of Article 250(2) and (4), as read with the criminal offense of Illicit Trafficking in Narcotic Drugs in violation of Article 195(1) of the Criminal Code of BiH.

Persons who have entered into the plea agreement with a Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of BiH are as follows:

-      Dragan Gajić, born on 09 February 1987 in Nikšić, with permanent residence in Herceg Novi, citizen of the Republic of Montenegro, and

-      Samir Etemović aka “Samko”, born on 25 May 1974 in Dubova- Tutin, resident of Sarajevo, citizen of BiH and the Republic of Serbia.

By signing the plea agreement, these accused persons have fully admitted the commission of the criminal offense they were charged with by the Indictment of the BiH Prosecutor’s Office dated 04 May 2012, which was confirmed in its entirety by a Preliminary Hearing Judge of the Court of BiH on 11 May 2012.

Both the Prosecutor and the Defense agree to have the Court of BiH pronounce a prison sentence upon the accused Dragan Gajić based on this plea agreement for a term of three (3) years, as well as to sentence the accused Samir Etemović to a prison sentence for a term of one (1) year, along with a security measure of forfeiture of objects used or destined for use in the perpetration of the criminal offense and those that resulted from the perpetration of the criminal offense.

The proposed sentences are consistent with the roles these accused persons had in the commission of the aforementioned criminal offense.   

Moreover, by signing the aforementioned plea agreement, these accused persons have taken upon themselves to testify on all the facts known to them that pertain to this criminal case, as well as on all the perpetrators, co-perpetrators and accomplices in the perpetration of the offenses alleged in the Indictment. In view of that, these accused persons agree to testify before the Court of BiH when summoned to do so by this court.  

With this plea agreement, the aforementioned accused persons confirm to be familiar with the content of the Indictment of the BiH Prosecutor’s Office. At the same time, they confirm to have entered their plea of guilty voluntarily, consciously and with understanding, and without any coercion or persuasion, and they also take upon themselves an obligation to reimburse the expenses of the criminal proceedings in the amount as determined by the Court of BiH.

With this plea agreement, these accused persons have waived their right to a trial and a right to appeal to a Verdict imposed upon them by the Court of BiH on the basis of this plea agreement.

The plea agreement has been forwarded to the Court of BiH.
