Due to the fact that a video, which was published on one internet portal on 21 May 2019 and then taken over by other portals and media, caused great public interest, the Prosecutor’s Office of BiH undertook a number of investigative activities in order to determine all the circumstances of the events and the persons listed in the media reports.

In the concrete case, during the course of conducting investigative activities evidence was collected and an order was issued to carry out an investigation involving the suspected persons Marko Pandža and Nermin Alešević due to suspicion that they committed the criminal offense referred to in Article 217 of the CC BiH (Accepting Gifts and Other Forms of Benefits) and Article 218 of the CC BiH (Giving Gifts and Other Forms of Benefits), and the suspect Alešević also for the criminal offense of Unauthorized Tapping and Sound Recording referred to in Article 155 of the RS Criminal Code.

In the aforementioned case, a number of witnesses were examined, including the President of the HJPC BiH, Milan Tegeltija.

The Prosecutor’s Office of Bosnia and Herzegovina continues the investigation in this case, and as soon as a prosecutorial decision is made the public will be informed.

We are also announcing that considering the fact that lately intense , everyday pressure has been present in the work of the HJPC of BiH, the Prosecutor’s Office of Bosnia and Herzegovina and the judiciary of Bosnia and Herzegovina as a whole, which has, to a certain extent, begun to interfere with the regular work of the judiciary, hence the Prosecutor’s Office of Bosnia and Herzegovina has, with due care and in accordance with the law, formed a case to investigate the motives and the reasons of persons sending such negative messages through the media regarding the work of the judiciary aiming to destabilize the judicial system.

We also emphasize that all cases must be dealt with institutionally and in accordance with the law.

Let us remind you of the principle of presumption of innocence, which defines that no person shall be considered guilty until his/her guilt has been established by a final verdict.
