THE ACCUSED EZEDIN DELIBAŠIĆ (1961) ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

The accused Ezedin Delibašić has entered into the plea agreement admitting guilt for the criminal offense of Tax Evasion, as referred to in Article 210, paragraph 1 of the Criminal Code of Bosnia and Herzegovina.

The accused Ezedin Delibašić, born on 08 February 1961 in Kakanj, where he also resides, citizen of BiH, has entered into the plea agreement with a Prosecutor of the Department III of the Prosecutor’s Office of BiH admitting quilt for the criminal offense charged.

By signing the plea agreement, the accused person has fully admitted the commission of the criminal offense he was charged with by the Indictment of the Prosecutor’s Office of BiH dated 17 September 2008.

Pursuant to this Plea Agreement, both the Prosecutor and the Defense agree that the Court of BiH sentence the accused Ezedin Delibašić to a suspended sentence by pronouncing a prison sentence in the duration of one (1) year and, at the same time, determine that the pronounced sentence will not be carried out if this accused person does not perpetrate another criminal offense over a period of three (3) years from the day the Verdict enters into force, as well as that, pursuant to Article 110, Article 60 and Article 63 of the Criminal Code of BiH, the amount of KM 43,180.55 be confiscated from him as the material gain acquired by the commission of the criminal offense. The accused is to return this amount during the period of six (6) months; otherwise, the suspended sentence will be revoked and the execution of the pronounced sentence will be ordered. 

The proposed sentence is consistent with the role this accused person had in the commission of the aforementioned criminal offense.   

With this plea agreement, the aforementioned accused person confirms to be familiar with the content of the Indictment of the Prosecutor’s Office of BiH. At the same time, he confirms to have entered his plea of guilty voluntarily, consciously and with understanding, without coercion or persuasion, and he takes upon himself an obligation to reimburse the expenses of the criminal proceedings in an amount that may be determined by the Court of BiH.

With this plea agreement, this accused person waives his right to a trial and right to appeal to the Verdict imposed upon him by the Court of BiH on the basis of this plea agreement.

This plea agreement has been forwarded to the Court of BiH.
